A new era has begun in the land registry in Turkey

How will real estate sales take place at the notary? Will there be an extra charge? The new era in real estate sales started today. The purchase and sale process, which was only done in the land registry offices, will now also be possible in notaries. So what should we pay attention to in the process? Will there be an extra fee?

The Ministry of Justice and the Union of Notaries of Turkey have completed their preparations for all immovable sales, such as land, field, residence, business place, to be carried out at notaries.

The new application started nationwide. The first application took place in Ankara with the participation of the Minister of Justice, Yılmaz Tunç. Minister Tunç said, “From now on, transactions related to the sale of immovables, which can only be done on weekdays at the land registry, will also take place on weekends.”

The person who wants to sell his property will apply by selecting the notary where he wants to carry out the transaction through the e-Application system on the website of the Union of Notaries of Turkey.

Upon detection by the notary that the applicant is the rightful owner of the property, the application will be accepted and the process will be initiated.

Upon acceptance of the application, the notary will examine the land registry records related to the property, and it will be checked whether there is a situation preventing the sale.

CONTRACTS WILL BE SIGNED IN THE PRESENCE OF THE NOTARY

After determining that there is no situation preventing the sale of the property, a message will be sent to the mobile phones of the interested parties for the payment of the necessary stamp duty and land registry revolving capital service fee.

After the payment of taxes and expenses, the parties will be invited to the notary to sign the prepared immovable sales contract.

Contracts will be signed by the buyer and seller in the presence of the notary. The signed contracts will be recorded in the system. Then, with the electronic submission of the contracts to the Land Registry and Cadastre Information System, the immovable will be registered in the land registry.

The title deed and other documents to be prepared after the transfer of the property will be delivered by the notary.

WILL NOTARIES CHARGE A FEE?

In the transactions made at the land registry, a title deed fee equivalent to 4% of the sale price is paid.

Notaries will charge an additional fee for this.

The notary fee cannot be less than 500 liras and more than 4,000 liras depending on the value of the property.

In addition, these amounts will increase at the revaluation rate each year.

WILL THERE BE A SALE TRANSACTION AT THE WEEKEND?

Minister of Justice Tunç, in his statement on the subject, had stated that the new application will reduce the intensity in the land registry directorates and will enable citizens to complete their transactions in a shorter and faster time.

Minister Tunç had stated that within the scope of the on-duty notary application, immovable sale contracts can also be made on weekends.
